Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and the operator of OTServers.org ("we", "us", "our") concerning your access to and use of the OTServers.org website and related services (the "Service"). By accessing the Service you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, do not use the Service.

OTServers.org is a directory of Open Tibia game servers. Listings are created by users; player counts, uptime and rankings are measured by our own automated status checks of the listed game servers and are never self-reported. We are not affiliated with CipSoft GmbH, and we do not operate, endorse or verify the game servers listed. Playing on a listed server is entirely at your own risk and subject to that server's own rules.

Listing a server is free and never requires payment to appear. Servers above a published player threshold may be asked to hold a paid highlight to remain listed, as described on the Advertising page.

Measured statistics. We query each listed server directly on its game port. Reported numbers that our own checks contradict, combining several worlds behind one login to inflate a listing, or counting parked characters as active players are grounds for delisting without notice.

You must be at least 16 years old, or the age of digital consent in your country if it is higher, to create an account; younger players may browse the directory but need a parent or guardian to handle owner features. You agree to provide accurate registration information and to keep your password secure; activity under your account is your responsibility. An account is required only for owner features (claiming listings, buying promotions) — browsing and voting do not require one. You may create API keys that let software you run act as your account over our agent interface; whatever that software does with the key is your responsibility, and keys are subject to the same limits as the account.

Claiming. Ownership of a listing is proven by placing a phrase we give you where only the server's operator can: in the server's message of the day, in a DNS TXT record on its website's domain, in a file served from that website, or in a meta tag on its homepage. Until a claim is verified you may edit the listing's description but not its website address, and an account may hold a limited number of unverified listings. We may revoke a claim obtained through unauthorized access or place a seeded listing with its operator ourselves.

Paid features are purchased with a prepaid coin balance. Coins are bought with a one-time payment processed by Stripe; by purchasing you also agree to Stripe's terms. Coins are a prepaid credit for use on the Service only: they are not money, are not transferable between accounts and cannot be paid out.

Promotions (highlight, featured box, launch countdown) are time-based placements that start when activated and expire automatically. Banner campaigns are billed per counted click; repeat clicks within the published deduplication window and detected crawlers are not billed. Banner creatives are reviewed before serving; creatives that are misleading, adult or unrelated to Open Tibia are refused and the reserved budget returned. We may pause or remove a running promotion whose content or destination begins violating these Terms; where the violation is not yours to remedy, unused budget is returned to your coin balance.

Refunds. Coins are digital content delivered immediately. Before checkout you confirm that you ask for immediate delivery and, if you are an EU consumer, acknowledge that you lose the 14-day right of withdrawal once the coins are credited; that confirmation is recorded with the payment. Coin purchases and spent coins are otherwise final and non-refundable, except where a technical failure on our side prevents a paid placement from serving at all — in that case we return the coins or provide a comparable placement. If we fail to activate a paid promotion within 48 hours of purchase, contact us for a full refund of that purchase. No promotion guarantees a ranking position, traffic volume or player count.

By submitting content to the Service (listing details, descriptions, banner creatives) you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt and display that content in connection with operating and promoting the Service. You represent that you own or are licensed to use everything you submit, including server names and artwork.

You may not submit listings or creatives that:

• are illegal, defamatory, adult, or promote gambling for money;
• impersonate another server, product or brand, or squat on its name to intercept its search traffic;
• distribute malware, or link clients or downloads containing malicious code;
• manipulate the ranking: bots or scripts inflating votes, players or any measured figure;
• scrape the Service to build a competing dataset without written permission.

We may remove any listing or creative, revert a paid placement, or suspend an account for breaches of this section, without notice and without refund. Brand owners can report an infringing listing at the contact address below.

The Service, its design, code and content (excluding user content and third-party game assets) are owned by us and protected by applicable intellectual-property laws. Tibia and related game assets are the property of CipSoft GmbH; their appearance on listed servers or fan artwork does not imply any right granted by us.

The Service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Measured statistics are collected on a best-effort schedule and may be incomplete or delayed; we make no warranty that the Service will be uninterrupted, timely, accurate or error-free.

To the fullest extent permitted by law, we will not be liable for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profits, revenue or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the six months before the cause of action arose. Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer rights.

These Terms are governed by the laws of Poland. You and we consent to the exclusive jurisdiction of the Polish courts for any dispute connected with these Terms, without prejudice to mandatory consumer protections of your country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We may update these Terms; material changes are announced on the Service and apply from the date posted. Continued use after that date constitutes acceptance.
